The struggle for Freedom and Security

Freedom rights, such as free speech and the Right to Privacy are two of the most important human rights and core values of our democratic (Western) society. New technologies, e.g. smart phones, create new private domains and often promote freedom, privacy and security. However, as governments, technology companies and citizens have different interests, public safety can be at odds with the rights of individuals. The ‘FBI vs Apple iPhone case’ (cracking the smart phone of a terrorist) is an example of a dilemma where collective and individual interests conflict.

Jan Smits is professor of Legal and Technology at Eindhoven University of Technology (TU/e). He discusses several examples of conflicting collective and individual interests from a legal perspective.
